4(1)A person who has the capacity to make decisions may make a health care directive.
4(2)For the purposes of this Act, a person
(a)
has the capacity to make a decision if he or she is able to understand the information that is relevant to making the decision and able to appreciate the reasonably foreseeable consequences of the decision or lack of decision, and
(b)
is presumed to have capacity, unless the contrary is demonstrated.
